Legal Warranty

Each product sold by Heart-Sound Italy S.r.l to a buyer “consumer” is assisted by a legal warranty on consumer goods, which covers the lack of conformity which could occur within two (2) years from the date of delivery of the product.

What does legal warranty stand for?

It is the guarantee on the sale of consumer goods provided by the EU Directive 1999/44/EC, also known as “guarantee of compliance“, which protects you in the event that the products you buy may present defects in conformity with the sale contract (“Legal Warranty“).

This happens, for example, in the case of products that do not work well, that cannot be used in accordance to the instructions stated by the seller or for the purposes for which similar products are commonly used, or that they do not have the features or quality guaranteed by the seller or they cannot be used for the purposes for which they have been purchased.

The consumer is obliged to inform the seller of any defect within two months of its discovery, penalty the of forfeiture of the warranty.

We recommend that you keep your purchasing receipt including the original packaging of the product, as well as all documents confirming the shipment and delivery of the product.


Am I entitled to the legal warranty?

The Legal Warranty is of concern to the consumer, i.e. to those who have bought products for non-business purposes.

For example, if you purchase an asset solely for your own personal use, you are entitled to the legal warranty. On the contrary, if the purchase is done for commercial use, the legal warranty does not apply.


Towards whom is the Legal Warranty applicable?

If you are a consumer you can make the legal warranty valid against those who sold you the product, even if it is a person different from the manufacturer.

For products purchased at Heart-Sound Italy S.r.l., Heart-Sound Italy S.r.l. answers itself.

For products sold by third parties, for example, authorized dealers from Heart-Sound Italy S.r.l., the legal warranty is charged to the seller and Heart-Sound Italy S.r.l. has no responsibility concerning this issue.


What rights does the Legal Warranty give me?

If the product you purchased has a defect which is covered by the legal warranty, you are entitled, without having to incur any expense, to either have the product repaired or replaced by the seller.

You are entitled to a price reduction or termination of the contract (i.e. the reimbursement of the paid price by returning the defective product to the seller) in the following cases:

(a) if the replacement or repair of the product is not possible or it is extremely expensive (for example, if the replacement / repair involves costs that exceed the value of the product);

(b) if the seller has failed to neither repair nor replace the product in a reasonable period of time;

(c) whether the replacement or repair of the product has caused you significant inconvenience.

To determine the amount of reduction of price or amount to which you are entitled in such cases we take into account the use you have made of the product. Keep in mind that a minor defect for which it has not possible or is too costly, the options of repair or replacement does not give the right to terminate the contract.


What to do in case of a lack of conformity?

If the product you have purchased from Heart-Sound was delivered damaged, defective, or it is not what you ordered, or otherwise does not comply with the sale contract, please contact our Customer Service at [email protected].

Our Customer Service staff will help you solve your problem regarding the use of the product you have purchased.

If it appears that the problem derives from lack of conformity, an internal slip will be opened, free of charge and under warranty, regarding the repair or replacement of the defective product.

Please note that in case of replacement, we will deliver you a replacement product within a reasonable time and you are asked to return the non-compliant product within 30 days from the date you received our communication regarding the dispatch of the replacement product.
